The letter to the Treasury, I
think, had better say that we fear it is extremely unlikely that we should get leave
to appeal in this case; point out what appears
to us to be the difficulty in the Admiralty's suggestion, and suggest that they should give us authority to ask the Treasury Solicitor to obtain an opinion as to the possibility of an appeal, and that the question as to who should bear the costs if an appeal was possible should
be left over for consideration until we have
got the opinion.
